Our lawyers know insurance. This helps us in every case for every client, whether we are trying to secure a defense for our client, or trying to recover under another party’s policy. We also represent insurance clients directly. Our lawyers have litigated insurance coverage disputes, bad faith claims, and have written coverage opinions both for claimants and carriers. Cain & Skarnulis has a breadth of industry knowledge, including:
- The firm has acted as defense counsel for E&O and D&O claims for shareholder litigation, fiduciary liability and other claims. Although we are not an “insurance defense” firm, we explore coverage for our clients and then work closely with their carriers to manage litigation.
- We have defended carriers in many cases alleging bad faith in a failure to defend or settle claims against insureds.
- We are one of the few firms to really “get” reinsurance law. We have had cases involving highly specific areas of reinsurance. Whether it’s facultative or treaty reinsurance, we understand the business. We have litigated issues involving commutations, bordereaux reporting, the “follow the fortunes” doctrine, ceding commissions, and liability for EC damages.
- Our firm has handled complex disputes involving county mutuals, managing general agencies, and brokers and intermediaries. We have successfully tried or mediated a number of agency cases.
